Terms and Conditions

1. Scope and General Provisions

All deliveries, services, offers and intermediary services provided by Alpine Flights (hereinafter “Alpine Flights” or the “Operator”) are rendered exclusively on the basis of these Terms and Conditions. These Terms and Conditions apply to all flight contracts (commercial and private) as well as to intermediary services between the Operator and the customer (hereinafter “Customer” or “Client”).

The German-language version is legally binding. By ordering a voucher, booking a flight or using any service, these Terms and Conditions are deemed accepted. Deviating terms of the Customer shall not be recognized unless Alpine Flights expressly agrees to them in writing.​

3. Description of Services and Subject Matter of the Contract

Alpine Flights offers different types of flight services. The legal position of Alpine Flights depends on the type of service booked:

3.1 Intermediation of Flight Experiences

Where Alpine Flights offers flights of other operators, Alpine Flights acts solely as an intermediary. In this case, the contract for the respective experience is concluded directly between the Customer and the respective operator. The operator’s terms and conditions apply to the execution of the flight. Alpine Flights is not liable for the performance of intermediary services.

3.2 Own Commercial Flight Operations (AOC)

Commercial flights are carried out by Alpine Flights under the AOC (Air Operator Certificate) of Airport Helicopter AHB (CH.AOC.3002). These flights are performed commercially for remuneration and are subject to the strict statutory regulations applicable to commercial air transport. The contracting carrier is the aviation company stated on the ticket (AOC holder).

3.3 Private Flights on a Cost-Sharing Basis

Alpine Flights also offers private flights on a cost-sharing basis in accordance with EASA regulation (Art. 6(4a) Regulation (EU) No. 965/2012) and national law (SR 748.01).

Key feature: The actual direct costs (charter, fuel, fees) are shared among all occupants (including the pilot). No profit is generated.
Note: These flights are not subject to the same safety standards as commercial flights (e.g., AOC).

4. Contract Conclusion and Booking

4.1 Booking and Acceptance

By booking (in writing, by e-mail, web form or telephone), the Customer submits a binding offer. The contract is concluded upon written confirmation (booking confirmation/invoice/ticket) issued by Alpine Flights.

4.2 Vouchers

A flight ticket or voucher constitutes an order confirmation. Vouchers are only valid once paid in full.

5. Prices, Payment Terms and Delivery

5.1 Prices

All stated prices are final prices. Where Alpine Flights is subject to VAT, VAT is included; if the small-business scheme is applied, this will be indicated separately.
For flights abroad, the Customer bears any additional costs for fees, permits or customs duties.

5.2 Payment Terms

Vouchers: Payment by invoice or online payment. Delivery is made only after receipt of payment.
Direct bookings: The flight price is due before the flight as agreed. For short-notice bookings, payment is due immediately.
Default: If the Customer fails to pay on time, Alpine Flights may refuse performance and may charge cancellation fees pursuant to Section 8.

5.3 Delivery

Vouchers are delivered by e-mail (free of charge) or, upon request, by post. Shipping costs within Switzerland are borne by Alpine Flights. For delivery abroad, vouchers are provided exclusively in digital form.

6. Validity and Transferability of Vouchers

6.1 Validity Period

Value vouchers: Value vouchers (amount in CHF) are valid for 10 years in accordance with the Swiss Code of Obligations (CO/OR). They may be credited against any Alpine Flights offer.
Flight tickets / service vouchers: Vouchers for specific services (e.g., “30 min scenic flight”) have a basic validity of 12 months from the date of issue (price guarantee). After expiry, they may still be credited as a value voucher; any price increases must be paid additionally.

6.2 Transferability

Vouchers may be freely transferred to other persons. Alpine Flights assumes no liability for loss or theft.

6.3 No Cash Payout

Cash payout of the voucher value is excluded.

7. Right of Withdrawal and Return of Vouchers

Customers may cancel value vouchers within 14 days from the order date without stating reasons, provided that the service has not yet been used.
A processing fee of CHF 25 per voucher will be charged for the cancellation.
Flights already scheduled or performed are excluded from withdrawal.

8. Cancellation, Rescheduling and No-Show

Appointments are binding. Cancellations or rescheduling must be made in writing (e-mail). The decisive date is the time the notice is received by Alpine Flights.

8.1 Commercial Flights (AOC)

Up to 7 days before the flight date: free of charge
7 days to 24 hours before the flight date: 50% of the total price
Less than 24 hours before the flight date or no-show: 100% of the total price

8.2 Private Flights on a Cost-Sharing Basis

Up to 10 days before the flight date: free of charge
10 days to 24 hours before the flight date: 50% of the total price
Less than 24 hours before the flight date or no-show: 100% of the total price

8.3 Cancellation by Alpine Flights

Alpine Flights may cancel or postpone flights at any time for important reasons (weather, safety, technical issues, pilot illness, regulatory requirements).
Consequences: The flight will be rescheduled to a new date free of charge. Further claims (travel costs, hotels, etc.) are excluded.
Group flights: If the required minimum number of participants (typically 4 persons for commercial flights) is not reached, the flight may be rescheduled.​

9. Requirements for Performance

9.1 Weather Decision

The pilot makes the final decision on whether a flight can be performed. The Customer must ensure availability (mobile phone) for the weather decision. If the Customer cannot be reached and therefore does not appear, this is deemed a “no-show” (100% charge).​

9.2 Personal Requirements & Weight

The Customer must provide truthful information about their weight.
Alpine Flights reserves the right to refuse carriage if weight information was incorrect and safety limits would be exceeded. In this case, the flight price remains payable.
Passengers under the influence of alcohol or drugs will be excluded from the flight without any right to a refund.​

10. Liability and Insurance

10.1 Commercial Flights

For commercial flights, the legally required liability and accident insurance for passengers applies. Liability is governed by the applicable aviation laws. Baggage is covered within statutory limits.

10.2 Private Flights (Cost Sharing)

Claims are excluded unless intent or gross negligence is proven.
Important note: For private flights there is no automatic accident insurance comparable to commercial transport. The Customer is responsible for their own insurance coverage (accident insurance).​

10.3 Intermediation

Where Alpine Flights acts purely as an intermediary, Alpine Flights is not liable for damages resulting from the flight performed by a third-party operator. The performing operator is solely liable.

10.4 Exclusion of Liability

Any liability for indirect damages, consequential damages, loss of profit or delay damages is excluded to the extent permitted by law.

11. Data Protection

Personal data required for the business relationship is stored and processed in compliance with applicable data protection laws (Swiss FADP/DSG and GDPR). Data is disclosed to third parties (e.g., AOC operator, authorities) only where necessary for contract performance (e.g., passenger lists) or legally required.​

12. Final Provisions

12.1 Severability Clause

If individual provisions of these Terms and Conditions are invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a provision that comes closest to the economic purpose of the invalid provision.

12.2 Applicable Law and Jurisdiction

Swiss law applies exclusively.
Exclusive place of jurisdiction for all disputes arising from this contract is Altenrhein (Canton of St. Gallen), unless mandatory statutory jurisdictions take precedence.​
